(vii) Dispute Resolution

Any disputes arising out of or relating to this Agreement will first be attempted to be resolved through good faith negotiation between the parties. If a resolution cannot be reached, the parties agree to use a mutually agreed-upon mediator before resorting to litigation.

(viii) Force Majeure

Neither party shall be liable for any failure or delay in performing its obligations under this Agreement if such failure or delay is due to circumstances beyond its reasonable control, including but not limited to acts of God, national emergencies, war, terrorist acts, riots, strikes, or governmental action.

(ix) Electronic Communications, Transactions, and Signatures

Using the Product, sending us emails, and completing online forms constitute electronic communications. You consent to receive electronic communications, and you agree that all agreements, notices, disclosures, and other communications we provide to you electronically, via email and on the Product, satisfy any legal requirement that such communication be in writing.

(x) Correction of Errors

The Parties acknowledge that despite their best efforts, errors or discrepancies may occur in the drafting of this Agreement. Therefore, if any typographical errors, discrepancies, inconsistencies, ambiguities, omissions or similar errors are found in this Agreement, The Home Mission shall have the unilateral right, but not the obligation, to correct such errors or discrepancies in order to ensure the integrity and clarity of the Agreement, without the requirement for the consent or approval of any other Party. Any corrections made under this clause will be effective immediately upon notice to the other Parties, which may be given by any reasonable means including via email or through an update posted on a website provided by The Home Mission.

You may use the Website for lawful purposes only.

You agree to be financially responsible for all purchases made by you or someone acting on your behalf through the Website. You agree to use the Website and to purchase courses or products through the Website for legitimate, non-commercial purposes only. All sales for digital downloadable products are final.

There are no exceptions. 

It is your responsibility to ensure that you have reviewed the product details and compatibility before making a purchase. However any request for a refund will be denied.

You may be presented on the sales page the opportunity to pay in instalments, where you can choose to commit to a monthly payment plan, detailed on the sales page, which is automated for your convenience through Stripe or PayPal.

Should there be any issues with your payment, we’ll try 4 times to ensure we’re not interrupting your learning. However, if your payment plan does fall behind, your access to the course materials will be paused – and you will lose access to course materials until you are back on track. We want to keep everyone on the same page, marching towards our shared goal of growth and empowerment.

Therefore, it’s important to remember that these payment plans are not mere subscriptions or memberships that you can cancel, but a commitment to The Home Mission Limited and your own self-improvement. Any use by you of optional tools offered through the site is entirely at your own risk and discretion, and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).

  • You cannot pass on the resale rights to your customers unless granted with express permission with a licence and certificate from The Home Mission.
  • You cannot give the product away for free or as a lead magnet.
  • You cannot use the advertised cover when reselling these products/courses.
  • You cannot use the same name for the product as The Home Mission.
  • You cannot list the product using promotional images from our shop.
  • You cannot copy and paste our product description; create your own instead.
  • You cannot use our ads; you can create your own to differentiate your brand.
  • You cannot make any changes or modifications to the Product without changing its name and its branding. Templates and training are provided.
  • You cannot offer the Product as a bonus, sell it on auction sites, or use it in dime/penny sale events.
  • You cannot offer refunds on the Product.
  • You cannot develop a competing product using this Product or enter into a similar licensing agreement with a direct competitor of The Home Mission Limited during the term of this Agreement and for one year following its termination.
  • Sell the Product with/ without resell rights for less than the minimum prices
  • Licensing: Each purchase includes a license for individual use. For MRR Rebrand Resell Rights Licenses, additional purchases are required.
  • Support: Support for these products is provided as-is and without warranty.

SECTION 17 – Use of Free Downloadable Content

The Company may make resources on this Website accessible to users in exchange for providing an e-mail address (“Gated Content”). The Company grants you a limited, personal, non-exclusive, non-transferable license to use the Gated Content for your own personal or internal business use. Any such changes, suspensions, or discontinuances will be effective immediately upon notice to the other Parties, which may be given by any reasonable means including via email or through an update posted on a website provided by The Home Mission.

Your use of the Website and any associated services may sometimes be subject to interruption or delay. Due to the nature of the Internet and electronic communications, we and our service providers do not make any warranty that our Website or any associated resources or services will be error-free, without interruption or delay, or free from defects in design. We will not be liable to you should our Website or the resources or services supplied through our Website become unavailable, interrupted or delayed for any reason.

You shall not settle any third-party claim or waive any defence without our prior written consent.

The subject headings of the paragraphs and subparagraphs of this Agreement are included for convenience only and shall not affect the construction or interpretation of any of its provisions.

These Terms of Service refer to all Products and Services including but not limited to; Templates and Tools, Creative Courses, Friendly Funnels and Rebrand Resells, and any rights and licenses granted hereunder, shall remain in effect unless and until terminated by either you or us.

  • You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.
  • If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).
  • This Agreement shall commence on the Effective Date of Purchase and shall continue in full force until terminated as provided herein. Either party may terminate this Agreement at any time, with or without cause, by providing the other party a written notice of termination.

Upon termination of this Agreement for any reason, all rights granted to the Licensee under this Agreement, including the right to resell the “The Home Mission Liberation Courses aka Rebrand Resells” product, shall immediately cease, and the Licensee shall immediately cease all use, promotion, and sales of the Product. The Licensee shall also, within 10 days of the termination date, destroy or return to the Licensor any confidential information or materials provided by the Licensor under this Agreement.

Termination of this Agreement shall not affect any rights or obligations that:

  • Are meant to survive termination (including but not limited to indemnification and limitations of liability);
  • Have accrued prior to such termination; and/or
  • The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

Any waiver by us of a breach of or right under these Terms will not constitute a waiver of any other or subsequent breach or right. No waiver shall be binding unless executed in writing by the Company. If any provision of this Agreement is found by a court of competent jurisdiction to be invalid or unenforceable, the parties agree that the court should endeavour to give effect to the parties’ intentions as reflected in the provision, and the other provisions of the Agreement remain in full force and effect. This right of enforcement extends to any modifications, additions, or updates to the terms and conditions of this Licensing Agreement made in the future. You agree that We reserve the right to modify the terms and conditions of this Licensing Agreement at any time, and it is your responsibility to review the Agreement periodically for any such changes. Your continued use of the licensed materials or failure to terminate this Agreement after such changes have been posted constitutes your acceptance of these changes.

If you violate any future updates, modifications, or additions to this Licensing Agreement, We will have the right to enforce the updated Agreement and seek all available remedies, including the filing of a lawsuit.

SECTION 30 – Governing Law

These Terms, including with the Privacy Policy and Disclaimers shall be construed in accordance with, and governed by, the laws of the United Kingdom, and the courts of United Kingdom shall have jurisdiction to hear and determine any dispute arising in relation to these Terms. We may assign any or all of our rights and obligation to others at any time. We shall not be responsible or liable for any loss, damage, delay, or failure to act caused by any cause beyond our reasonable control. If any provision or part of a provision of these Legal Terms is determined to be unlawful, void, or unenforceable, the provision or part of the provision is deemed severable from these Legal Terms and does not affect the validity and enforceability of any remaining provision .

There is no joint venture, partnership, employment, or agency relationship created between you and us as a result of these Legal Terms of use of the Product. You agree that these Legal Terms will NOT be construed against us by virtue of having drafted them.
